A federal court in New Jersey granted preliminary approval of a class action settlement filed by Leonard Smith against New England Motor Freight. Mr. Smith alleged that NEMF violated the Fair Credit Reporting Act in the course of using pre-employment background checks to screen job applicants. In his case, the report was grossly inaccurate, and as alleged in the complaint, led to a decision not to hire him. Although NEMF denied any wrongdoing, a settlement was reached that could pay affected class members up to $800.00.
